AN ACT TO CREATE A NEW § 3105.1 OF 22 GCA TO PROVIDE PAID SICK LEAVE FOR PRIVATE SECTOR EMPLOYEES AT A RATE COMPORABLE TO CLASSIFIED EMPLOYEES OF THE GOVERNMENT OF GUAM FOR THE HEALTH AND SAFETY OF GUAM’S WORKING FAMILIES MADE CRITICAL AS A RESULT OF THE H1N1 PANDEMIC AND TO AMEND SUBSECTIONS (C) AND (D) OF § 4108, 4 GCA FOR CONSTANCY WITH THE RECOMMENDATIONS OF THE CENTER FOR DISEASE CONTROL AND PREVENTION REGARDING SICK LEAVE TIME ALLOWED TO ALL EMPLOYEES WITHOUT DOCTORS CERTIFICATION; TO BE HEREBY KNOWN AS THE WORKING FAMILY HEALTH LEAVE ACT OF 2009

Q: What does The Working Family Health Leave Act do?
A: It ensures that every worker on Guam has reasonable and fair PAID sick leave.
Q: Why?
A: Many private sector workers have no, very little or hard to use paid sick leave which not only creates incredible hard ship on their families but endangers everyone on Guam.
Q: How does Bad or No paid Sick leave endanger Guam’s Families?
A: When workers don’t have paid sick leave they go to work even when they are sick, this in turn spreads their illness to their co-workers and customers. This is how Pandemics happen.
Q: What does the Center for Disease Control (CDC) recommend?
A: The CDC recommends “Stay home if you are sick. If you have symptoms of influenza-like illness, stay home for 7 days after symptoms begin or until you have been symptom-free for 24 hours, whichever is longer. Following these recommendations will help keep you from infecting others and spreading the virus.”
Q: How Does paid sick leave protect children?
A: When parents have paid sick leave they are more likely to allow their child to stay home from school or day if they are sick because they can stay home to watch them. This protects all of our children, who are especially susceptible to H1N1, and meets the CDC recommendation.
Q: What are the specific Paid Sick leave benefits for Private Sector Workers?
A: They accrue sick leave with pay at a rate of 30 minutes for every 10 hours worked, which is the same for Public Servants (including senators).
Q: Can I use my sick leave to take care of my child or a family member who is ill?
A: Yes, for both the Private and Public sector. This is a change for public servants who were recently banned from staying home if their child had the flu.
Q: Will I need to get a Doctor’s note every time I’m sick?
A: No. Mandatory doctors notes to justify staying home sick not only violates CDC recommendations and endangers health care workers but adds a huge burden on Guam’s already strained health care infrastructure and a financial burden on families and employers.

A: Employers, both public and private, may request one if an employee is forced to be absent for more than 7 days or takes sick leave while on vacation.
